1. General principles
This policy applies to hosting, VPS/virtual server, domain name, cloud backup, business email, SSL/license, web development, maintenance and related digital services offered by Kuzgun Yazılım Bilişim ve Danışmanlık Limited Şirketi under the KuzgunHost brand.
The consumer's rights under Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts and other mandatory legislation are reserved. An order-specific quotation or agreement may not be interpreted in a manner that diminishes the consumer's statutory rights.
2. Order cancellation before activation
Cancellation may be requested if the service has not yet been activated, the domain name has not been registered, no license or certificate has been allocated, and custom work has not begun. If performance is impossible or the Provider does not accept the order, the applicable amount collected will be refunded through the same payment method.
The amount may take additional time to appear in the account because of processing times at the bank or payment institution.
3. 14-day right of withdrawal for consumers
A customer acting as a consumer may give notice of withdrawal without stating a reason within 14 days from the date the service agreement is concluded, subject to the exceptions prescribed by law.
The notice must be sent within the applicable period in writing or through a durable medium such as email. A telephone call alone does not constitute a notice of withdrawal; written or email confirmation must be sent after the call.
4. Services that may be excluded from refunds
Without prejudice to rights arising from defective service and mandatory legislation, the following items may be excluded from refunds after activation or allocation:
- Domain names whose registration or renewal has been completed, and fees paid to the registrar.
- Activated SSL certificates, software licenses, control panel licenses and third-party products.
- Hosting, VPS, server, email, backup and similar instantly performed digital services whose setup has been completed or which have been made available for use.
- Resources reserved specifically for the customer, dedicated IP addresses, setup, migration, consulting and technical labor charges.
- The completed portion of custom web design or development work commenced with the customer's approval, and non-recoverable third-party costs.
5. Renewal and subscription cancellation
The customer may request cancellation of automatic renewal or the next service period before renewal for the new period is processed. Unless otherwise agreed in writing, cancellation does not prevent the service from continuing until the end of the current paid period.
If domain name, license or third-party costs have been incurred after renewal is completed, those items may be excluded from a refund. Duplicate or erroneous charges attributable to the Provider will be corrected after verification.
6. Defective, incomplete or unavailable service
If the service does not conform to the agreed essential characteristics, is incomplete or has not been provided at all, the customer may exercise the statutory elective remedies, including remedy of the issue, renewed performance, a price reduction or rescission of the agreement.
Interruptions caused by scheduled maintenance, customer configuration, third-party software, internet connectivity, attacks, unlawful use or force majeure are reviewed in light of the nature of the incident, the service terms and any applicable service-level commitment.
7. Refund method and timeframe
- The request is reviewed against the order and service records.
- If additional information is required, the customer will be contacted through the registered communication channel.
- If a refund is approved, it will be made in a single transaction within the period prescribed by law and in a manner compatible with the payment instrument used by the customer.
- The time required for a card refund to appear in the account may vary by bank or payment institution.
The statutory refund period applies to a valid notice of withdrawal. Requests from corporate or commercial buyers are assessed under the quotation, service agreement and commercial terms between the parties.
8. Cancellation or refund application
To help us process your application promptly, provide your full name or business name, order or invoice number, service name, relevant domain name or server details, reason for the request, and an express cancellation or withdrawal statement.
